Adrianna Papell Holiday S’HUG® Giveaway

 

 Official Rules

NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT IMPROVE YOUR CHANCES OF WINNING.

1. The Adrianna Papell Holiday S’HUG® Giveaway [S’HUG®] is open to legal residents of United States of America. Entrants must be 18 years of age or older as of date of entry. This Giveaway is subject to federal, state and local laws and regulations and void where prohibited by law. Employees, officers and directors of Adrianna Papell and its parent companies, subsidiaries, affiliates, partners, advertising and promotion agencies, manufacturers, or distributors of Giveaway materials (collectively, “Employees”), as well as members of an Employee’s immediate family of the same and/or those living in the same household of Employees are ineligible to enter the Adrianna Papell Holiday S’HUG® Giveaway.

 

2. Sponsorship: The Sponsor is Adrianna Papell LLC and its parent, affiliate and subsidiary companies (“Sponsor”), located at 500 7^th Avenue, New York, NY 10018. Sponsor will conduct the Giveaway substantially as described in these Official Rules. 

 

3. Agreement to Rules: By entering this Giveaway, the Entrant (“You”) agrees to abide by the Sponsor's Official Rules and decisions, which are fully and unconditionally binding in all respects. The Sponsor reserves the right to refuse, withdraw, or disqualify any entry at any time at the Sponsor’s sole discretion. By entering this Giveaway, You represent and warrant that You are eligible to participate in the Giveaway based on eligibility requirements explained in the Official Rules. You also agree to accept the decisions of the Sponsor as final and binding as it relates to the content of this Holiday S’HUG® Giveaway.

 

4. Timing: The Giveaway begins on Wednesday, November 16, 2022, at 12:00 AM Eastern Time ("ET") and ends on Wednesday, November 22, 2022, at 11:59 PM ET ("Entry Period").

 

5. How to Enter.Eligible Entrants can enter the Adrianna Papell Holiday S’HUG® Giveaway by signing up to receive emails from Adrianna Papell and by following the Adrianna Papell Instagram account. Entry into the Giveaway is by this process only. Limit 1 entry per person per email. No automated entry devices and/or programs permitted. An Entrant who attempts to participate with multiple email addresses or under multiple identities or uses any device or artifice to enter multiple times will be disqualified. In the event of a dispute over the identity of an entrant, entry will be deemed submitted by the authorized account holder of the email address associated with the entry. “Authorized Account Holder” is defined as the person assigned to an email address or phone number by a recognized provider. All materials submitted become the property of Sponsor and will not be returned. Sponsor is not responsible for lost, late, illegible, stolen, incomplete, invalid, unintelligible, misdirected, technically corrupted or garbled entries or mail, which will be disqualified, or for problems of any kind whether mechanical, human, or electronic.  Proof of submission will not be deemed to be proof of receipt by Sponsor. By entering the Giveaway, entrants fully and unconditionally agree to be bound by these rules and the decisions of the Sponsor, which will be final and binding in all matters relating to the Giveaway.

 

6. RandomDrawing/Odds.  5 entrants will be randomly selected by the Sponsor to receive a prize. Limit 1 entry per person.  Odds of winning a Prize depend upon the total number of eligible entries received. By entering the Giveaway, You fully and unconditionally agree to be bound by these Official Rules and the decisions of the Sponsor, which are final and binding in all matters relating to the Giveaway. Sponsor will announce the 5 Winners via private email on or about November 23, 2022 (“Winner Announcement”). The Winners must contact Sponsor via an email as provided in the email within 2 days of the Winner Announcement to redeem their prize and to provide a valid mailing address to the Sponsor. If the Winner does not redeem the Prize within 2 days of the Winner Announcement, the Prize will be forfeited, and Sponsor will award the Prize to an alternate winner randomly drawn from the original pool of entrants.  If the Prize cannot be awarded after 3 alternate winners have been notified, the prize will remain unawarded.

 

7. 5 entrants (Winners) will win a S’HUG® from www.adriannapapell.com.  Approximate Retail Value (“ARV”) of each Prize is $100.00.  Limit one (1) Prize per winning entrant. Prizes are non-transferable.  No substitutions or cash redemptions are permitted. In the case of unavailability of any Prize, Sponsor in its sole discretion reserves the right to substitute a prize of equal or greater value.  All expenses not specifically listed herein are the responsibility of the winners.  All federal, state and local taxes are the sole responsibility of the Winner.

 

8. Prize Delivery.Winners will be sent Prize within 1 week of receipt of Sponsor’s receipt of the Winners’ mailing address. The Sponsor is not responsible if the Prize cannot be delivered due to an incorrect address or for lost or misdirected requests.

 

9. All taxes are the sole responsibility of the Winners. By participating, You agree to release and hold harmless Sponsor and its advertising and promotion agencies and its parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers, directors and members, from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with, preparation for, travel to, or participation in Giveaway, or possession, acceptance and/or use or misuse of prize or participation in any Giveaway-related activity and claims based on publicity rights, defamation or invasion of privacy and merchandise delivery.  Entrants who do not comply with these Official Rules or attempt to interfere with this Giveaway in any way, shall be disqualified. Prizes are non-transferable and there are no substitutions or cash redemptions. In the case of unavailability of any prize, Sponsor reserves the right to substitute a prize of equal or greater value.  There is no purchase or sales presentation required to participate. A purchase does not increase your odds of winning.

 

10. Additional Terms for Online Giveaway. Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend this Giveaway should (in its sole discretion) virus, bugs, non-authorized human intervention or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Giveaway. In such case, Sponsor will select the Winners from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right, at its sole discretion, to disqualify any Entrant it finds, in its sole discretion, to be tampering with the entry process or the operation of the Giveaway. Additionally, Sponsor reserves the right to prosecute any fraudulent activities to the full extent of the law.  In case of dispute as to the identity of any Entrant, entry will be declared by the Authorized Account Holder of the email address or phone number submitted at time of entry. “Sponsor, is not responsible for technical, hardware, software, telephone or other technical or communications malfunctions including, but not limited to lost/delayed data transmission, omission, interruption, deletion, defect, line failures or any telephone network, computer equipment, software, inability to access any Website or on-line service, incorrect or inaccurate transcription of entry information, or for any human error or failures or lost or unavailable network connections, Website, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one's ability to enter the Giveaway, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participating in this Giveaway or downloading any materials in this Giveaway.

 

CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE; THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

 

11. By receipt of the Prize, winners agree to release and hold harmless Sponsor and Sponsor’s suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, members, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Giveaway or receipt or use or misuse of any prize.

 

12. Use of Data.Sponsor will be collecting personal data about Entrants online, in accordance with its privacy policy.  Please review the Sponsor’s privacy policy https://www.adriannapapell.com/pages/privacy-policy. By participating in the Giveaway, Entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s privacy policy.

 

13. List of Winners.To obtain the name of the winners, send a self-addressed, stamped envelope by November 30, 2022, to Adrianna Papell, LLC ATTN: Adrianna Papell Holiday S’HUG® Giveaway, 500 7^th Ave, 10^th Floor, New York, NY 10018.

 

14. Entrant Submissions/License Granted to Adrianna Papell, LLC.By submitting your submissions, You expressly acknowledge and agree that You, and only You, will be responsible for the content of your submissions and for any consequences that may arise therefrom. When You submit (or attempt to submit) your entry you automatically grant to Sponsor an irrevocable, perpetual, worldwide, unconditional, unrestricted, fully-paid, royalty-free, transferable, fully sub-licensable, non-exclusive right and license to display, distribute (including, without limitation, through third-party sites, blogs, microblogs and other social networking media and Internet resources), store, host, broadcast, webcast, transmit, distribute, tag, reproduce, edit, modify, delete, create derivative works, and/or otherwise use, reuse, assign, and/or otherwise exploit your submissions and any names, likenesses, voices, images, digital recordings, performances, and other ideas, concepts, feedback and other materials included in your submissions, in any manner, medium or content now known or hereinafter devised, for any purpose, as determined solely in Sponsor’s (or its authorized designees/licensees') sole discretion, without the requirement for any compensation to You or anyone else, or the need to require additional consent from You or anyone else, or the need to provide prior notification or any credit to You or anyone else.
